TERMS & CONDITIONS / TERMS OF SERVICE

These Terms & Conditions ("Agreement") govern the relationship between Kelana Voyages LLC ("Kelana Voyages," "we," "us," or "our") and the client ("you," "your," or "traveler") who engages our travel planning, booking, or advisory services.
BY USING OUR SERVICES, REQUESTING QUOTES, OR MAKING TRAVEL BOOKINGS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS ON BEHALF OF YOURSELF AND ALL MEMBERS OF YOUR TRAVEL PARTY. IF YOU DO NOT AGREE, YOU MAY NOT USE OUR SERVICES.
IMPORTANT: A signed Booking Agreement incorporating these Terms by reference is required before any deposit will be accepted. Electronic signatures and digital acceptance shall have the same legal effect as handwritten signatures under applicable law.
1. AGENCY ROLE – THIRD-PARTY SUPPLIERS
Kelana Voyages acts solely as an independent contractor and agent for travel suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, and transportation providers ("Suppliers").
We do not own, operate, or control these Suppliers.
Kelana Voyages is not the provider of travel services and shall not be deemed a co-vendor, joint venturer, or partner with any Supplier.
All bookings are subject to the terms, conditions, and policies of the applicable Supplier.
We are not liable for Supplier errors, cancellations, service failures, schedule changes, delays, overbookings, quality of services, or insolvency.
Your legal recourse for travel services lies with the Supplier, not Kelana Voyages. We will make commercially reasonable efforts to assist you in resolving Supplier disputes on your behalf.
REGULATORY DISCLOSURE: Kelana Voyages complies with all applicable federal and state travel seller regulations. Where required by the laws of the client's state of residence (including California, Florida, Washington, and Hawaii), services may be fulfilled under host agency licensing or applicable registrations. Clients from regulated states are encouraged to inquire about applicable consumer protections.
2. CLIENT RESPONSIBILITY & DOCUMENT REVIEW
You are responsible for:
Reviewing all itineraries, invoices, and travel documents upon receipt
Ensuring all names match government-issued identification exactly
Notifying us immediately (within 24 hours of receipt) of any discrepancies
Ensuring all travelers in your party are aware of and agree to these Terms
Failure to notify us of discrepancies within 24 hours of receipt may result in denied boarding or additional fees for which Kelana Voyages is not responsible.
Minor Travelers
If your travel party includes travelers under the age of 18 ("Minors"):
You represent and warrant under penalty of perjury that you are the parent or legal guardian of any Minor, or that you have obtained written notarized consent from the Minor's parent or legal guardian authorizing travel.
Unaccompanied minor travel is subject to each Supplier's individual policies, which you must confirm before booking.
Many international destinations require additional documentation for Minors traveling with only one parent or with non-parents. You are solely responsible for obtaining such documentation.
3. PAYMENTS, DEPOSITS & FEES
All prices are subject to change until confirmed and paid in full. Final payment deadlines must be strictly adhered to; failure to make timely payment may result in automatic cancellation without further notice.
PRICING NOTICE: Quoted pricing is not guaranteed until a booking is fully confirmed and paid. Pricing may change at any time without prior notice due to Supplier-controlled inventory, dynamic pricing systems, fuel surcharges, taxes, or currency fluctuations. A quote provided today is not a guarantee of availability or pricing tomorrow.
Kelana Voyages Service Fees
Kelana Voyages reserves the right to charge the following fees, which are separate from Supplier charges. Current fee ranges are set forth in the Fee Schedule (Exhibit A):
Planning / Consultation Fees
Change / Revision Fees
Cancellation Processing Fees
Document / Visa Research Fees
All Kelana Voyages service fees are non-refundable once services have been rendered, regardless of whether the underlying trip proceeds.
Commission Disclosure
Kelana Voyages may receive commissions, incentive payments, overrides, or other compensation from Suppliers in connection with your booking. Such compensation is standard industry practice and does not affect the price you pay unless separately disclosed in writing at the time of booking.
4. CANCELLATIONS, CHANGES & REFUNDS
All cancellations and changes are subject to Supplier policies, which may include complete forfeiture of amounts paid. You are strongly encouraged to review Supplier cancellation terms at time of booking.
All cancellation requests must be submitted in writing to KelanaVoyages@gmail.com.
A cancellation request is not effective until acknowledged in writing by Kelana Voyages.
Upon receipt of a written cancellation request, Kelana Voyages will notify applicable Suppliers within 2 business days and communicate refund eligibility to you within 30 calendar days.
Total refund processing time is controlled by the Supplier and may range from 30 to 120 days. Status updates are available upon written request.
Refunds, if any, are issued by the Supplier — not Kelana Voyages — and are subject to Supplier approval.
Kelana Voyages is not responsible for loss of funds due to missed deadlines or failure to follow Supplier cancellation procedures.
NOTE: Initiating a credit card chargeback instead of following this cancellation procedure does not constitute proper cancellation and may result in additional fees and legal action per Section 10.
5. TRAVEL INSURANCE
Kelana Voyages STRONGLY RECOMMENDS that all travelers purchase comprehensive travel insurance covering trip cancellation and interruption, medical expenses, evacuation, baggage loss, and Supplier default.
Failure to purchase travel insurance may result in total loss of trip cost, including all non-refundable deposits and pre-paid expenses.
Insurance coverage is governed solely by the policy provider and its terms. Kelana Voyages makes no representations regarding coverage outcomes.
Insurance Declination
If you choose to decline travel insurance, you must sign the Travel Insurance Declination Form (Exhibit B) before your booking is confirmed. By signing, you acknowledge that you have been offered insurance, have declined it, and assume full financial risk for all resulting losses.
WARNING: A medical evacuation alone can cost $50,000–$250,000 or more. Trip cancellation for any reason can result in 100% forfeiture of non-refundable travel costs. Kelana Voyages strongly encourages consultation with an insurance professional before declining coverage.
6. TRAVEL DOCUMENTS & ENTRY REQUIREMENTS
You are solely responsible for obtaining, verifying, and complying with all travel documentation and entry requirements for all destinations on your itinerary, including transit countries:
Valid passports (at least 6 months beyond return date where required)
Visas and entry permits
Vaccinations, health documentation, and testing requirements
Exit requirements and departure taxes
Customs and currency regulations
Requirements can change on short notice. Verify requirements with the relevant embassy, consulate, or official government source within 72 hours of departure. Failure to comply may result in denied boarding, fines, detention, or deportation at your sole expense.
7. RISKS OF TRAVEL & ASSUMPTION OF RISK
Travel involves inherent risks, including illness, injury, pandemics, weather, political instability, transportation delays, criminal activity, and loss of personal property. By booking, you voluntarily accept these risks for yourself and your entire travel party.
Errors & Omissions Coverage
Kelana Voyages maintains Errors & Omissions (E&O) professional liability insurance through its host agency, Cornerstone. However, coverage applicability is determined solely by the insurer on a claim-by-claim basis and is not guaranteed for any specific claim or circumstance. The existence of E&O coverage does not expand Kelana Voyages' contractual liability beyond the limits set forth in Section 11.
Accessibility & Special Needs
We will make commercially reasonable efforts to accommodate disabilities, mobility limitations, dietary restrictions, or other special needs disclosed to us in writing at the time of booking. Kelana Voyages will communicate these requirements to Suppliers but cannot guarantee fulfillment. Ultimate ADA compliance responsibility rests with the Supplier.
8. PRICE CHANGES & AVAILABILITY
Travel pricing is dynamic and subject to change due to fuel costs, currency fluctuations, taxes, and Supplier adjustments. Quotes are not guaranteed until a booking is confirmed and paid in full.
If a price increase occurs after deposit but before full payment, we will notify you in writing within 5 business days. You may accept the new price or cancel. If the increase exceeds 10% of the total trip cost, you may cancel for a full refund of amounts paid to Kelana Voyages (Supplier refund policies apply separately).
9. GROUP TRAVEL TERMS
This section applies to bookings of 10 or more travelers. All Group Bookings require a separate signed Group Travel Agreement addendum.
Minimum Participation & Attrition
Group pricing is based on a confirmed minimum number of paid travelers specified in the Group Travel Agreement.
If the minimum is not met by the deposit deadline, pricing may increase or the booking may be cancelled at the Supplier's discretion.
Suppliers may impose attrition clauses requiring payment for a minimum percentage of the group block regardless of actual attendance. Attrition financial responsibility is specified in the Group Travel Agreement.
Group Leader Responsibilities
The Group Leader coordinates the group, communicates with Kelana Voyages, distributes all documents, and may bear financial responsibility for attrition penalties.
Changes to rooming lists after final deadlines may incur Supplier-imposed change fees.
9A. CRUISE-SPECIFIC TERMS
The following terms apply to all cruise bookings in addition to the general Terms & Conditions herein.
Missed Embarkation
You are solely responsible for arriving at the embarkation port on time. Kelana Voyages is not responsible for missed embarkation due to flight delays, traffic, weather, or any other cause. If you miss embarkation, you may attempt to join the ship at the next port of call at your own expense, subject to availability. No refunds will be issued for missed embarkation. Travel insurance covering trip interruption and missed departure is strongly recommended for all cruise bookings.
Ship Itinerary & Port Changes
Cruise lines reserve the right to modify, substitute, or cancel ports of call, itineraries, and onboard programming at any time for safety, weather, mechanical, or operational reasons. Such changes do not constitute a cancellation of your booking and do not entitle you to a refund of the cruise fare unless the cruise line issues a specific refund under its own policies. Kelana Voyages is not liable for itinerary changes made by the cruise line.
Port Cancellations
Individual port cancellations by the cruise line do not entitle you to any refund or compensation from Kelana Voyages. Any compensation offered is solely at the cruise line's discretion and subject to its policies. You agree to pursue any port cancellation compensation directly with the cruise line.
Cabin Assignment
Cabin category guarantees are subject to the cruise line's assignment process. Specific cabin numbers are assigned by the cruise line, not Kelana Voyages, and may be changed at the cruise line's discretion. Kelana Voyages will relay your cabin preferences to the cruise line but cannot guarantee specific cabin locations, decks, views, or configurations. Cabin assignment changes by the cruise line do not entitle you to cancellation or refund of Kelana Voyages service fees.
10. CREDIT CARD AUTHORIZATION & CHARGEBACK POLICY
By providing payment information, you authorize Kelana Voyages or the applicable Supplier to charge your card for confirmed bookings, deposits, fees, and agreed charges.
Chargeback Policy
You agree not to initiate a credit card chargeback for services properly rendered or for charges consistent with Supplier cancellation policies agreed to at booking. Before initiating any dispute with your card issuer, you agree to:

You further agree that this Agreement, booking confirmations, communications, and Supplier terms may be submitted as evidence in any chargeback or payment dispute resolution proceeding.
Unauthorized or improper chargebacks may result in suspension of services, legal action, and recovery of all associated costs and reasonable attorney's fees.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KELANA VOYAGES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF ENJOYMENT, EMOTIONAL DISTRESS, MISSED CONNECTIONS, OR LOST BUSINESS OPPORTUNITIES.
In the event of a confirmed booking error attributable solely to Kelana Voyages, liability shall be limited to correction of the booking or refund of the associated Kelana Voyages service fees — not Supplier charges or third-party costs.
Our total aggregate liability for any and all claims arising from our services shall not exceed the lesser of: (a) fees paid directly to Kelana Voyages (excluding Supplier payments) for the specific booking, or (b) $2,500.00.
This limitation applies regardless of the form of action. We are not responsible for Supplier failures, third-party acts, or Force Majeure events as described in Section 12.
12. FORCE MAJEURE
Kelana Voyages is not liable for failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, government-issued travel restrictions, health emergencies, government actions, travel bans, border closures, acts of terrorism, war, civil unrest, labor strikes, infrastructure failures, or Supplier insolvency. We will use commercially reasonable efforts to notify you promptly and assist with rebooking or refund requests subject to Supplier policies.
13. CLAIMS & DISPUTES
Any claim or complaint must be submitted in writing to KelanaVoyages@gmail.com within 60 days of trip completion (or scheduled return date if the trip did not occur). Claims not submitted within this period are waived. Any legal action must be filed within one (1) year of the events giving rise to the claim.
13A. Binding Arbitration
PLEASE READ CAREFULLY — THIS SECTION REQUIRES BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION.
Any dispute arising out of or relating to this Agreement or our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall take place in Iberia Parish, Louisiana, or via videoconference at the consumer's option.
Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.
YOU AND KELANA VOYAGES AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY. NO CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE PROCEEDINGS ARE PERMITTED.
SMALL CLAIMS EXEMPTION: Either party may bring an individual claim in Iberia Parish small claims court as an alternative to arbitration if the claim qualifies jurisdictionally.
To the maximum extent permitted by law, if the arbitration agreement is found unenforceable as to a particular claim, that claim shall be resolved in courts in Iberia Parish, Louisiana.
14. GOVERNING LAW & JURISDICTION
This Agreement is governed by the laws of the State of Louisiana, without regard to conflict of law provisions. Subject to Section 13A, all disputes not subject to arbitration shall be resolved exclusively in state or federal courts in Iberia Parish, Louisiana.
15. PRIVACY & DATA USE
By using our services, you consent to the collection and use of personal information as described below.
Data We Collect
Personal identification data (name, date of birth, passport details), contact information, payment information (processed securely; full card numbers are not stored), travel preferences, health or dietary needs, and special requests.
How We Use Your Data
To book and manage travel services, share with Suppliers as necessary, communicate with you about your booking, and comply with legal obligations. We do not sell your personal data to third parties.
International Transfers & Retention
International bookings may require transfer of your data to countries outside the United States. By proceeding with an international booking, you consent to such transfers. Booking records are typically retained for 7 years for tax and legal compliance purposes.
Data Security & Breach Notification
We take commercially reasonable measures to protect your data. In the event of a breach, we will notify you as required by Louisiana Revised Statutes 51:3071 et seq. You may request access to, correction of, or deletion of your data by contacting us in writing.
Marketing Consent
By using our services, you consent to use of anonymized trip details, general booking information, or client testimonials for Kelana Voyages marketing and promotional purposes, including social media, unless you notify us in writing that you object to such use.
Clients located in the European Union or California may have additional rights under GDPR or CCPA; contact us to exercise them.
16. CLIENT CONDUCT
Kelana Voyages is committed to providing professional, courteous service. In return, we expect respectful conduct from all clients.
Kelana Voyages reserves the right to refuse, suspend, or terminate services at its sole discretion in cases of:
Abusive, threatening, harassing, or discriminatory behavior (including based on any protected class) toward any Kelana Voyages agent or staff
Repeated unreasonable demands inconsistent with the scope of services engaged
Material non-compliance with these Terms or the Booking Agreement
Fraud, misrepresentation, or submission of false documentation
In the event of service termination for client conduct reasons, no refund of Kelana Voyages service fees will be provided for services already rendered. Supplier refund eligibility, if any, remains subject to Supplier policies and will be communicated to you within 30 days of termination.
17. INTELLECTUAL PROPERTY
All content, branding, itineraries, and materials created by Kelana Voyages remain our exclusive intellectual property and may not be reproduced without written permission. If you provide materials for use in your itinerary, you warrant ownership rights and grant Kelana Voyages a limited license to use them solely for service delivery. We comply with the DMCA; infringement notices may be directed to KelanaVoyages@gmail.com.
18. MODIFICATIONS TO TERMS
We reserve the right to update these Terms at any time. For non-material changes, updates take effect upon posting. For material changes (fees, arbitration, liability, legal rights), we will provide 30-day advance written notice via email. Continued use after the 30-day notice period constitutes acceptance. If you do not agree to a material change, you may terminate this Agreement before the effective date, and confirmed bookings will continue under the prior Terms.
19. ENTIRE AGREEMENT, SEVERABILITY & WAIVER
These Terms, together with your signed Booking Agreement and any applicable addenda (Group Travel Agreement, Fee Schedule Exhibit A), constitute the entire agreement between the parties and supersede all prior communications.
If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to be enforceable, or severed, without affecting the remaining provisions. Failure by Kelana Voyages to enforce any provision shall not constitute a waiver of the right to enforce it in the future.

All Kelana Voyages fees will be disclosed in writing and accepted by Client prior to any work commencing. Once accepted, they are non-refundable.
